TOTAL COMBAT PAINTBALL RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OR RISK, AND INDEMNITY AGREEMENT (“AGREEMENT”)

Paragraph 1*

In consideration of participating in the SPORT OF PAINTBALL I the Participant, I represent, that I understand the nature of this Activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participating in the Activity.

Paragraph 2*

I fully understand that this Activity involves risks of serious bodily injury, Including permanent disability, paralysis and death, which may be caused by my own actions , or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the “releases” named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the Activity

Paragraph 3*

I hereby release, discharge, and covenant not to sue Total Combat Paintball, Inc. (TCP), its Respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the “RELEASES” herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence or the “releases” or otherwise, including negligent rescue operations; and I further agree that if , despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the Releases, I will indemnify, save, and hold harmless each of the releases from any loss, liability, damage, or cost which any may incur as the result of such claim.

I hereby irrevocably consent to and authorize TCP and its designees to take, reproduce, display, publish or otherwise use, at any time and from time to time, my image, voice, likeness, sound, persona, and any statements made by me, and any film, photographs or drawings of me, or any part thereof, in any form (including, but not limited to, still and moving images, illustrations and animations), either alone or accompanied by other material, in any manner, throughout the world, for advertising, publicity, trade or any other lawful purposes, in any medium now known or hereafter developed (including, but not limited to, on the World Wide Web), without compensation to me. In addition to use of my own image.

Paragraph 5*

I have read this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement and assurance of any nature and intend it be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be valid the balance, notwithstanding, shall continue in full force and effect.

(For Participants of Minority Age, Under age 18 at time of registration) AND I, the minor’s parent and /or legal guardian, understand the nature of the above referenced activities and the minor’s experience and capabilities and believe the minor to be qualified to participate in such activity. TOTAL COMBAT PAINTBALL SAFETY RULES*

NO SHOOTING IN NEUTRAL ZONES, INTO OR OUT OF COMMON AREAS, OR PARKING AREA. BARREL PLUGS MUST BE ON WHEN YOU ARE IN THESE AREAS. Players are never to discharge their guns anywhere except the target range or inside the field in which their game is being held on. Players are never to remove their barrel plug/socks unless they are told to do so by the referee or when at the target range.

MARKERS SHOULD BE CHRONOGRAPHED AT 280FPS OR LOWER

SAFETY MASK MUST BE WORN AT ALL TIMES. Players must wear approved safety mask at all times unless they are in the registration area or safe zone. At no time should you remove your mask, if for any reason you need to remove mask, please do so outside the dead box only paintball approved mask are allowed.

DO NOT SHOOT AT AIR BUNKERS INTENTIONALLY

NO BLIND FIRING: Meaning you should not shoot behind any object or bunker without visually seeing your opponent.

NO SHOOTING TOWARDS THE SKY: This is to insure the safety of all costumer's outside the playing field and pasting vehicles.

ALL RENTAL GUNS MUST REMAIN INSIDE PLAYING FIELD AT ALL TIMES

DO NOT REMOVE THE HOPPERS from our paintball guns, meaning the container that holds the paintball's.

NO OUTSIDE PAINTBALLS ALLOWED:

NO ALCOHOL OR ILLEGAL DRUGS ARE ALLOWED. Alcohol and illegal drugs are not permitted on the premises.

NO VERBAL ABUSE. Profanity, name calling, or slurs against anyone's race, color, religion, national origin, or family members will not be tolerated.

NO PHYSICAL CONTACT. Players should never touch another player or his or her equipment at any time.

THROWING PAINTBALLS AND/OR POURING THEM ON THE GROUND IS PROHIBITED. Guest are not allowed to throw paintballs or pour paintballs anywhere on the premises. Garbage cans are located throughout the grounds please use them.

REFEREES DECISIONS ARE FINAL. Players are not allowed to argue with any referee. Any discussions should be done after the game.

CLEAN UP AFTER YOURSELF AND THROW ALL TRASH INTO THE MULTIPLE CANS PROVIDED TCP IS NOT RESPONSIBLE for missing paintball's or personal items inside dead box.

DO NOT SIT ON TOP OF TABLES

ANY VIOLATION OF THE SAFETY RULES WILL RESULT IN THE PLAYER BEING REMOVED FROM PLAY FOR THE REMAINDER OF THE GAME. IF A SECOND INFRACITON OCCURS YOU WILL BE ASKED TO LEAVE FOR THE REMAINDER OF THE DAY. THERE WILL BE NO REFUNDS DUE TO EJECTION FROM FIELDS.
